READ CAREFULLY – BY CHECKING THE BOX YOU WAIVE CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE

Damage Responsibility & Payment Authorization

  • Participant is financially responsible for any damage, breakage, or loss to the Facility’s property or equipment caused by:

    • Their own acts or omissions,

    • Acts of minors/guests they supervise, or

    • Breach of facility rules.

  • Participant authorizes TARGET Indoor Golf to charge the credit card or payment method provided at booking or check-in for:

    • The cost of repair or replacement,

    • Reasonable labour and administrative fees,

    • Collection costs and legal fees if unpaid.

  • If a security deposit is collected, the Facility may apply all or part of it toward damages.

Indemnity

Participant agrees to defend, indemnify, and hold harmless the Released Parties from any claims, demands, or costs (including legal fees) brought by:

  • Other customers, invitees, or third parties for injuries or damages caused by the Participant or supervised minors/guests; or

  • The Releasing Parties themselves, to the extent released herein.

Medical Treatment & Costs

  • Participant consents to emergency medical treatment if deemed necessary and assumes responsibility for all related expenses.

Personal Property

  • The Facility is not responsible for loss, theft, or damage to personal belongings.

Governing Law & Venue

  • This Agreement is governed by the laws of the Province of Ontario.

  • Venue for disputes shall be the courts of Ontario.

  • Participant waives the right to trial by jury to the fullest extent permitted by law.

Severability & Entire Agreement

If any clause is found unenforceable, the remainder remains in force. This document is the entire agreement; no oral modifications are valid.

Electronic Signatures

Participant agrees that electronic signatures or check-box acceptance have the same force as handwritten signatures under Ontario’s Electronic Commerce Act.

Parent/Guardian Consent (if applicable)

I certify I am the lawful parent/guardian of the listed minor(s) and accept full responsibility for them, including damage charges, indemnity, and release of claims.

Acknowledgment

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I ACCEPT FULL RESPONSIBILITY FOR MYSELF, MY GUESTS, AND ANY MINORS I SUPERVISE. I AGREE TO BE BOUND BY ITS TERMS, INCLUDING PAYMENT FOR DAMAGES AND WAIVER OF LEGAL RIGHTS.
